The Fisheries (Southern Scallop Fishery Rotational Fishing) Notice (No. 2) 1996 (No. F46) Pursuant to section 28zzf (2) of the Fisheries Act 1983 and acting pursuant to delegated authority in accordance with section 41 of the State Sector Act 1988, the Manager Fisheries Services, Ministry of Fisheries hereby makes the following notice: N o t i c e 1. Title and commencement (1) This notice may be cited as the Fisheries (Southern Scallop Fishery Rotational Fishing) Notice (No. 2) 1996. (2) This notice shall come into effect the day after its notification in the New Zealand Gazette. 2. Interpretation In this notice any reference to the Southern Scallop Fishery means the fishery described in Part I of schedule 1D to the Fisheries Act 1983. 3. Rotational Fishing Areas No commercial fisherman shall take scallops from the following defined areas within the waters of the Southern Scallop Fishery. (a) Areas B and C The area contained by a straight line from the outer leading light at Collingwood (at approximately 40 40.7 S and 172 41.0 E) to Bush End Point Light, Farewell Spit (at approximately 40 32.9 S and 173 00.6 E) to Taupo Point (at approximately 40 47.4 S and 172 57.3 E) and then back along the mean high water mark to the point of commencement at the outer leading light at Collingwood (at approximately 40 40.7 S and 172 41.0 E). Except that scallops may be taken from Area B in that area enclosed by straight lines commencing at a point at 40 44.00 S and 172 46.00 E and proceeding to a point at a 40 44.00 S and 172 48.50 E and proceeding to a point at 40 44.80 S and 172 48.50 E and then to a point at 40 45.50 S and 172 47.79 E and proceeding to a point at 40 45.00 S and 172 46.00 E and back to the point of commencement at 40 44.00 S and 172 46.00 E. (b) Area E The area contained by a straight line commencing at Guilbert Point (at approximately 40 59.5 S and 173 02.2 E) to a point in mid Tasman Bay (at 41 02.8 S to 173 16.1 E) to Port Motueka (at approximately 41 08.3 S and 173 01.3 E) and back to the point of commencement. (c) Areas G and H: The area contained by a straight line commencing at the eastern end of Rabbit Island (at approximately 41 17.1 S and 173 11.8 E) to a point in mid Tasman Bay (at 41 02.8 S to 173 16.1 E) to Okuri Point (at approximately 40 58.6 S and 173 45.7 E) and then back along the mean high water mark to the point of commencement at the eastern end of Rabbit Island (at approximately 41 17.1 S and 173 11.8 E). (d) Marlborough Sounds Those waters of the Southern Scallop Fishery which lie east of longitude 173 50 E other than those waters enclosed by a straight line from the northernmost point of Nile Head at 40 38.7 S, 173 08.5 E to the northernmost point of Cape Stephens at 40 41.7 S, 173 57.5 E and then back along the mean high water mark to the point of commencement. 4. Cancellation of Previous Notice The Fisheries (Southern Scallop Fishery Rotational Fishing) Notice 1996 (No. F39) published in the New Zealand Gazette on the 15th day of August 1996, No. 85, at page 2258 is hereby cancelled.
