Right of Way and Utility Easements Acquired at Ford Road, Napier Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Regional Solicitor, Department of Survey and Land Information, Napier, declares that an agreement to that effect having been entered into, the easements described in the Third Schedule hereto, are acquired as easements appurtenant to the land described in the First Schedule over those parts of the land described in the Second Schedule as are specified in the Third Schedule and shall vest in Her Majesty The Queen for the purposes of access and utilisation of the land described in the First Schedule on the date of publication in the New Zealand Gazette. Such easements may be surrendered at any time by notice published in the New Zealand Gazette. Hawke's Bay Land District First Schedule Area ha Being 3.8726 Section 1, S.O. 10363, being all of the land in C.T. V1/167. Second Schedule Area ha Being 4.3346 Lot 2 on D.P. 23874, being all of the land in C.T. V1/656. Third Schedule Right of way. Right to convey water. Right to Drain Water. Right to convey sewage. Right to transmit electricity. Right to transmit telecommunications. Right to convey gas. Land Subject to the Easements: Those parts of the land in the Second Schedule; shown marked ``A'', ``F'', ``R'', ``Q'' and ``P'' on D.P. 23874. Rights and Powers of Easements: 1. The rights and powers set out in the Seventh Schedule to the Land Transfer Act 1952 shall apply to the right of way, right to convey water, right to drain water and right to drain sewage. 2. The rights and powers set out in the Seventh Schedule to the Land Transfer Act 1952 for a right to convey water shall apply (mutatis mutandis) to the right to transmit electricity, right to transmit telecommunications and right to convey gas.
