The Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994 Pursuant to sections 197, 234 and 235 of the Shipping and Seamen Act 1952 the Minister of Transport hereby gives the following notice. N o t i c e 1. Title and commencement (1) This notice may be cited as the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994. (2) This notice shall come into force 28 days after its notification in the New Zealand Gazette. 2. Code of Practice endorsed The International Code of Safety for High Speed Craft adopted by Resolution MSC 36 (63) of the International Maritime Organisation's Maritime Safety Committee dated June 1994 is hereby endorsed for the purposes of: Regulation 5 of the Shipping (Construction) Regulations 1989 Regulation 2 of the Shipping (Electronic Navigational Equipment) Regulations 1989 Regulation 4 of the Shipping (Fire Appliances) Regulations 1989 Regulation 5 of the Shipping (Lifesaving Appliances) Regulations 1989 Regulation 5 of the Shipping (Radio) Regulations 1989 Regulation 29 of the Shipping (Radio) Regulations 1994 3. Application The International Code of Safety for High Speed Craft shall apply to every new high speed craft which is: (i) a passenger ship which proceeds beyond extended river limits; or (ii) a passenger ship of 24 m or more in length which operates in river or extended river limits; or (iii) a non-passenger ship of 500 tons gross tonnage or over which proceeds beyond extended river limits. 4. Definitions and meanings ``High speed craft'' means a craft which is capable of a maximum speed equal to or exceeding: V 3.7 [li-2]0.1667[li2] where: V speed at displacement (in metres/second) displacement (in cubic metres) corresponding to the design waterline ``Length'' means the length overall ``New high speed craft'' means: (i) any New Zealand ship which is a high speed craft and which is built on or after the date of commencement of this notice; or (ii) any ship which is a high speed craft and which comes into operation as a New Zealand ship on or after the date of commencement of this notice. Other expressions used in this notice, which are defined in the Shipping and Seamen Act 1952 shall have the meaning so defined. 5. Consequential amendments to the Lifesaving Appliances Codes of Practice (1) The Lifesaving Appliances (Code of Practice for Existing Ships of Classes I and II) Notice 1989 is hereby amended: (a) by inserting, in paragraph 1 of the Schedule, after the definition of ``Existing ship'' the following definition: ``High speed craft'' has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994; (b) by deleting, in paragraph 2 of the Schedule, the words ``or surface effect ships.'' and substituting the phrase ``, surface effect ships or high speed craft''. (2) The Lifesaving Appliances (Code of Practice for New Ships of Classes I and II) Notice 1989 is hereby amended: (a) by inserting, in paragraph 1 of the Schedule, after the definition of ``Float-free launching'', the following definition: ``High speed craft'' has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994; (b) by deleting, in paragraph 2 of the Schedule, the words ``or surface effect ships.'' and substituting the phrase ``, surface effect ships or high speed craft''. (3) The Lifesaving Appliances (Code of Practice for Class III Ships) Notice 1989 is hereby amended: (a) by inserting, in paragraph 1 of the Schedule, after the definition of ``Class III ship'', the following definition: ``High speed craft'' has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994; (b) by deleting, in paragraph 2 of the Schedule, the words ``or surface effect ships.'' and substituting the phrase ``, surface effect ships or high speed craft''. (4) The Lifesaving Appliances (Code of Practice for Class IV Ships) Notice 1989 is hereby amended: (a) by inserting, in paragraph 1 of the Schedule, after the definition of ``Dinghy'', the following definition: ``High speed craft'' has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994; (b) by deleting, in paragraph 2 of the Schedule, the words ``or surface effect ships.'' and substituting the phrase ``, surface effect ships, or high speed craft of 24 m length or over''. (5) The Lifesaving Appliances (Code of Practice for Class V Ships) Notice 1989 is hereby amended: (a) by inserting, in paragraph 1 of the Schedule, after the definition of ``Class V ship'', the following definition: ``High speed craft'' has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994; (b) by deleting, in paragraph 2 of the Schedule, the words ``or surface effect ships.'' and substituting the phrase ``, surface effect ships, or high speed craft of 24 m length or over''. (6) The Lifesaving Appliances (Code of Practice for Class VI Ships) Notice 1989 is hereby amended: (a) by inserting, in paragraph 1 of the Schedule, after the definition of ``Dinghy'', the following definition: ``High speed craft'' has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994; (b) by deleting, in paragraph 2 of the Schedule, the words ``or surface effect ships.'' and substituting the phrase ``, surface effect ships or high speed craft''. (7) The Lifesaving Appliances (Code of Practice for New Ships of Classes VII, VIIA and VIII) Notice 1989 is hereby amended: (a) by inserting, in paragraph 1 of the Schedule, after the definition of ``Free-fall launching'', the following definition: ``High speed craft'' has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994; (b) by inserting after paragraph 1 of the Schedule, the following paragraph: ``1A. Application This Schedule applies to New Ships of Classes VII, VIIA and VIII except such ships which are high speed craft.'' (8) The Lifesaving Appliances (Code of Practice for Existing Ships of Class VII) Notice 1989 is hereby amended: (a) by inserting, in paragraph 1 of the Schedule, after the definition of ``Existing ship'', the following definition: ``High speed craft'' has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994; (b) by inserting after paragraph 1 of the Schedule, the following paragraph: ``1A. Application This Schedule applies to Existing Ships of Class VII except such ships which are high speed craft.'' (9) The Lifesaving Appliances (Code of Practice for Existing Ships of Class VIII) Notice 1989 is hereby amended: (a) by inserting, in paragraph 1 of the Schedule, after the definition of ``Existing ship'', the following definition: ``High speed craft'' has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994; (b) by inserting after paragraph 1 of the Schedule, the following paragraph: ``1A. Application This Schedule applies to Existing Ships of Class VIII except such ships which are high speed craft.'' (10) The Lifesaving Appliances (Code of Practice for Ships of Class IX) Notice 1989 is hereby amended: (a) by inserting, in paragraph 1 of the Schedule, after the definition of ``Dinghy'', the following definition: ``High speed craft'' has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994; (b) by inserting after paragraph 1 of the Schedule, the following paragraph: ``1A. Application This Schedule applies to Existing Ships of Class IX except such ships which are high speed craft.'' 6. Consequential amendments to the Fire Appliances Code of Practice (1) The Fire Appliances (Code of Practice for Ships of Classes I and II) Notice 1989 is hereby amended: (a) by inserting in paragraph 1 of the Schedule, after the definition of ``General Code'', the following definition: ``High speed craft'' has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994; (b) by deleting, in paragraph 2 of the Schedule, the words ``or surface effect ships.'' and substituting the phrase ``, surface effect ships or high speed craft''. (2) The Fire Appliances (Code of Practice for Ships of Class III) Notice 1989 is hereby amended: (a) by inserting in paragraph 1 of the Schedule, after the definition of ``General Code'', the following definition: ``High speed craft'' has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994; (b) by deleting, in paragraph 2 of the Schedule, the words ``or surface effect ships.'' and substituting the phrase ``, surface effect ships or high speed craft''. (3) The Fire Appliances (Code of Practice for Ships of Classes IV, V and Ships of Class VI less than 45 m) Notice 1989 is hereby amended: (a) by inserting in paragraph 1 of the Schedule, after the definition of ``General Code'', the following definition: ``High speed craft'' has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994; (b) by deleting, paragraph 2 of the Schedule and substituting the following paragraph: ``This Code of Practice applies to Ships of Class VI of less than 45 m except such ships which are hydrofoil ships, surface effect ships or high speed craft and to Ships of Classes IV and V except such ships which are hydrofoil ships, surface effect ships, or high speed craft of 24 m length or more.'' (4) The Fire Appliances (Code of Practice for Ships of Class VI of 45 m in Length and Over) Notice 1989 is hereby amended: (a) by inserting in paragraph 1 of the Schedule, after the definition of ``General Code'', the following definition: ``High speed craft'' has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994; (b) by deleting, in paragraph 2 of the Schedule, the words ``or surface effect ships.'' and substituting the phrase ``, surface effect ships or high speed craft''. (5) The Fire Appliances (Code of Practice for Ships of Classes VII, VIIA and VIII) Notice 1989 is hereby amended: (a) by inserting in paragraph 1 of the Schedule, after the definition of ``General Code'', the following definition: ``High speed craft'' has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994; (b) by deleting paragraph 2 of Part I of the Schedule and substituting the following paragraph: ``Part I of this Code of Practice applies to Ships of Classes VII, VIIA and VIII with a gross tonnage of 500 or over, except such ships which are high speed craft, and where otherwise stated.'' (6) The Fire Appliances (Code of Practice for Ships of Class IX) Notice 1989 is hereby amended: (a) by inserting in paragraph 1 of the Schedule, after the definition of ``General Code'', the following definition: ``High speed craft'' has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994; (b) by deleting paragraph 2 of Part I of the Schedule and substituting the following paragraph: ``Part I of this Code of Practice applies to Ships of Class IX of 45 m in length or over and with a gross tonnage of 500 or over except such ships which are high speed craft, and where otherwise stated.'' 7. Consequential amendments to the Ship Construction Codes of Practice (1) The Ship Construction (Code of Practice for Ships not Required to Comply with the Safety Convention) Notice 1989 is hereby amended: (a) by adding, in paragraph (b) of clause 3 of the Notice, after the words ``other than a hydrofoil ship or surface effect ship of Class II, III, and VI'', the words ``or high speed craft of Class II, III, VI and VIII.'' (b) by adding, in paragraph (c) of clause 3 of the Notice, after the words ``other than a hydrofoil ship or surface effect ship of Class IV and V'', the words ``or high speed craft of Class IV and V of 24 m length or more or high speed craft of Class IX with gross tonnage of 500 or more.'' (c) by inserting, in paragraph 1 of the Schedule, after the definition of ``Freeboard deck'', the following definition: ``High speed craft'' has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994; (2) The Ship Construction (Code of Practice for Ships Required to Comply with the Safety Convention) Notice 1989 is hereby amended: (a) by adding, in paragraph (a) of clause 3 of the Notice, after the words ``of Class I'', the words ``other than a high speed craft'' (b) by adding, in paragraph (b) of clause 3 of the Notice, after the words ``gross tonnage or more'', the words ``other than a high speed craft'' (c) by adding, in paragraph (c) of clause 3 of the Notice, after the words ``other than a hydrofoil ship or surface effect ship of Class II, III and VI'', the words ``or a high speed craft of Class II, III, VI, and VIII or high speed craft of Class IX of 500 gross tonnage or more.'' (d) by inserting, in paragraph 1 of the Schedule, after the definition of ``Gas Carrier'', the following definition: ``High speed craft'' has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994; 8. Consequential amendments to the Ship Construction and Safety Equipment (Code of Practice for Hydrofoil Ships and Surface Effect Ships) Notice 1989 The Ship Construction and Safety Equipment (Code of Practice for Hydrofoil Ships and Surface Effect Ships) Notice 1989 is hereby amended by deleting the definition of ``New hydrofoil ship or surface effect ship'' in clause 3 of the Notice, and substituting the following definition: ``New hydrofoil ship or surface effect ship'' means any hydrofoil ship or surface effect ship which comes into operation within New Zealand coastal waters on or after 1 November 1989 but before the date of commencement of the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994.''
