domestic students for the purpose of tertiary education> <level,4,> Notification of Class of Foreign Students to be Considered as Domestic Students for the Purpose of Tertiary Education Education (Foreign Students) Notice 1994 Pursuant to paragraph (e) of the definition of the term ``Domestic student'' in section 159 (1) of the Education Act 1989, the Minister of Education hereby gives the following notice: N o t i c e 1. Title and commencement (1) This notice may be cited as the Education (Foreign Students) Notice 1994. (2) This notice shall come into force on the 28th day after the date of its publication in the New Zealand Gazette. 2. Class of foreign students required to be treated as domestic students (1) For the purpose of paragraph (e) of the definition of the term ``Domestic student'' in section 159 (1) of the Education Act 1989, foreign students who are: (a) a child or step-child of a member of a diplomatic mission or consulate post; and (b) not exceeding 21 years of age at the date of commencement of the year in which they are undertaking tertiary education: shall be considered as domestic students. (2) Notwithstanding subclause (1) of this clause, no domestic student, within the meaning of this notice, shall be considered a domestic student for any period (a) after 31 December in the year in which they turn 21 years of age; or (b) after 31 December in the year in which the member of the diplomatic mission or consulate ceases to hold that position. Note: The effect of this notice is that dependent children of members of a diplomatic mission or consular post, enrolled in tertiary institutions, are to be treated for enrolment, course and fees purposes as if domestic students until the end of the calendar year the students turn 21 years of age, or the end of the year in which the member no longer holds that post. Dependent children who are 21 years and over on entry to New Zealand are treated as if foreign students.
