The Water Recreation (Fitzroy/Waiwhakaiho Beach) Notice 1994 I, Russell Kilvington, Director, Maritime Safety Authority, pursuant to the Water Recreation Regulations 1979*, and in exercise of powers delegated to me, pursuant to section 257a of the Harbours Act 1950, hereby give the following notice: N o t i c e 1. (a) This notice may be cited as the Water Recreation (Fitzroy/Waiwhakaiho Beach) Notice 1994. (b) This notice shall come into force 14 days after publication in the New Zealand Gazette and shall remain in force until revoked by further notice in the New Zealand Gazette. 2. Subject to the conditions set forth in the Second Schedule hereto, and pursuant to regulation 18 of the Water Recreation Regulations 1979, the area specified in the First Schedule, shall be designated as for the use of jet skis, wet bikes or personal water craft. First Schedule All that area of water of North Taranaki Bight at Fitzroy Beach within 200 metres of the waters edge and commencing at the mouth of the Waiwhakaiho River at its right bank and extending approximately 400 metres to the south west. Second Schedule 1. All persons in charge of a vessel shall adhere to and keep the provisions of all Acts and regulations not specifically exempted by this notice. 2. The area shall be marked as by two 2.5 metre high transit posts with a distance of not less than 3 metres or more than 6 metres between and painted with 300 mm bright orange and black bands erected on land in line with each side of each access lane, and the first post being sited at the waters edge. 3. A suitable notice as may be approved by the Senior Advisory Officer (Harbours Management), Wellington, shall be erected at the sites deemed necessary by the Senior Advisory Officer (Harbours Management).
