The Water Recreation (Lake Ruataniwha) Notice 1994 I, Russell Kilvington, Director, Maritime Safety Authority, pursuant to the Water Recreation Regulations 1979* and in exercise of powers delegated to me pursuant to section 257a of the Harbours Act 1950, hereby give the following notice: N o t i c e 1. (a) This notice may be cited as the Water Recreation (Lake Ruataniwha) Notice 1994. (b) This notice shall come into force 14 days after publication in the New Zealand Gazette and shall remain in force until revoked by further notice in the New Zealand Gazette. 2. Subject to the conditions set forth in the Fifth Schedule hereto, and pursuant to regulation 10 of the Water Recreation Regulations 1979, the areas specified in the First Schedule shall be designated as access lanes. 3. Subject to the conditions set forth in the Fifth Schedule hereto, regulations 7 (1) (a), 7 (1) (b) and 7 (2) and 8 (1) (a), 8 (1) (b) and 8 (2) of the Water Recreation Regulations 1979 shall not apply to the area specified in the Second Schedule. 4. Subject to the conditions set forth in the Fifth Schedule hereto, and pursuant to regulation 18 of the Water Recreation Regulations 1979, the area specified in the Third Schedule shall be designated as for the use of jet skis, wet bikes or personal water craft. 5. Subject to the conditions set forth in the Fifth Schedule hereto, and pursuant to regulation 18 of the Water Recreation Regulations 1979, the area specified in the Fourth Schedule shall be designated as for the use of jet skis, wet bikes or personal water craft. 6. The Water Recreation (Lake Ruataniwha) Notice 1983 is hereby revoked. First Schedule All that area of water of Lake Ruataniwha having a corner boundary commencing at a point 293, distance 670 metres from the South Island Rowing Association Control Building and all that area of water of Lake Ruataniwha having a corner boundary commencing at a point distance approximately 1000 metres in an easterly direction from the South Island Rowing Association Control Building. Second Schedule All that area of water of Lake Ruataniwha known as ``The Bay'' being north and west of the rowing course. Third Schedule All that area of water of Lake Ruataniwha being east of a line drawn in a southerly direction from the start of the rowing course to the northern bank of the Ohau B Canal but excluding that area east and south of the boom shielding the Ruataniwha spillway. Fourth Schedule All that area of water of Lake Ruataniwha known as ``Wairepo Arm'' and that area of Lake Ruataniwha known as ``The Bay'' and being adjacent to the motor camp shall be reserved for small craft propelled or driven solely by oars, paddles, or the wind. Fifth Schedule 1. Notwithstanding any other provision of this notice, no person who is permitted by any such provision to propel or navigate a small craft at a speed through the water exceeding 5 knots shall do so in any manner that is likely to endanger or unduly annoy any person who is, in, on, or using the waters or fishing, or undertaking any recreational activity in the vicinity of the small craft. 2. All persons in charge of a vessel shall adhere to and keep the provisions of all Acts and regulations not specifically exempted by this notice. 3. The access lanes shall be marked as by two 2.5 metre high transit posts with a distance of not less than 3 metres or more than 6 metres between and painted with 300 mm bright orange and black bands erected on land in line with each side of each access lane, and the first post being sited at the waters edge. 4. A suitable notice comprising a map showing the various designated use areas shall be erected at the major entry points to the lake. Dated at Wellington this 14th day of July 1994. R.
