The Fisheries (Southern Scallop Fishery Rotational Fishing) Notice 1994 (No. 5356) Pursuant to section 28zzf (2) of the Fisheries Act 1983 and delegation made pursuant to section 41 of the State Sector Act 1988, the Acting Deputy Group Director, MAF Fisheries hereby makes the following notice: N o t i c e 1. Title and commencement (1) This notice may be cited as the Fisheries (Southern Scallop Fishery Rotational Fishing) Notice 1994. (2) This notice shall come into effect on the 9th day of August 1994. 2. Interpretation In this notice any reference to the Southern Scallop Fishery means the fishery described in Part I of Schedule 1D to the Fisheries Act 1983. 3. Rotational Fishing Areas No commercial fishermen shall take scallops from the following defined areas within the waters of the Southern Scallop Fishery. (a) Areas A and B: Those waters enclosed by a straight line commencing at Bush End Point Light, Farewell Spit (at 40 32.9S and 173 00.6E) to Patons Rock (at 40 47.3S and 172 45.8E) and then back along the mean high water mark to the point of commencement at Bush End Point Light, Farewell Spit (at 40 32.9S and 173 00.6E). (b) Area D: Those waters enclosed by a straight line commencing near Totaranui (at 40 49.0S and 173 00.9E) to the outer edge of the Separation Point Coral Patch (at 40 47.7S and 173 07.7E) to a point in mid Tasman Bay (at 41 02.8S and 173 16.1E) to Fishermans Island (at 40 59.7S and 173 03.1E) to Guilbert Point (at 40 59.5S and 173 02.2E) and then back along the mean high water mark to the point of commencement at a point near Totaranui (at 40 49.0S and 173 00.9E). (c) Areas F, G and H: Those waters enclosed by a straight line commencing at Motueka (at 41 08.3S and 173 01.3E) to a point in mid Tasman Bay (at 41 02.8S and 173 16.1E) to Okuri Point (at 40 58.6S and 173 45.7E) and then back along the mean high water mark to Motueka (at 41 08.3S and 173 01.3E), but excluding an area within Area F, contained within straight lines commencing at a point at 41 06.5S and 173 10E, to a point at 41 06.5S and 173 12E, to a point at 41 08S and 173 12E, to a point at 41 08S and 173 10E, and back to the point of commencement at 41 06.5S and 173 10E. (d) Waitata Bay, Marlborough Sounds: The waters of Waitata Bay lying inside a straight line from the Southern entrance of Waitata Bay (at 40 59.1S and 173 55.8E) to the Northern entrance of Waitata Bay (at 40 58.45S and 173 56.85E). 4. Cancellation of Previous Notice The Fisheries (Southern Scallop Fishery Rotational Fishing) Notice (No. 2) 1993 (No. 5307) published in the New Zealand Gazette on the 18th day of November 1993, Issue No. 169 at page 3435 is hereby cancelled.
