The Fire Appliances (Code of Practice for Ships of Classes I and II) Notice 1989, Amendment No. 1 Pursuant to section 235 of the Shipping and Seamen Act 1952, the Minister of Transport hereby gives the following notice. N o t i c e 1. Title and commencement (1) This notice may be cited as the Fire Appliances (Code of Practice for Ships of Classes I and II) Notice 1989, Amendment No. 1 and shall be read together with and deemed part of the Fire Appliances (Code of Practice for Ships of Classes I and II) Notice 1989 (hereinafter referred to as the principal notice). (2) This notice shall come into force on the 30th day of May 1994. 2. Clauses amended (1) Clause 1 of the Schedule to the principal notice is hereby amended by revoking the definition of ``New ship'' and substituting the following definition: `` `New ship' means a ship of which the keel was laid, or in respect of which a similar stage of construction is reached: (a) in the case of a ship of Class I, or Class II of 45 metres or more in length, on the 1st day of September 1984; and (b) in the case of a ship of Class II of less than 45 metres in length, on the 1st day of November 1989; and for the purpose of this definition, ``similar stage of construction'' means the stage at which construction identifiable with the ship comprises at least 50 tonnes or 1 percent of the estimated mass of the structural material of the completed ship, whichever is the less. A cargo ship, whenever built, which is converted to a passenger ship shall be treated as a passenger ship constructed on the date on which such a conversion commences.'' (2) Clause 1 of the Schedule to the principal notice is further amended by inserting, after the words ``weight of which'' in line 1 of the definition of ``Surface effect ship'', the word ``in''. (3) Clauses 3 (1), 3 (2), 3 (3), 3 (4), 3 (6), 5 (2), 5 (5), 8 (1), 12 (1) and 12 (4) of the Schedule to the principal notice are hereby amended by deleting the words: ``In every ship of Class I, and every ship of Class II of 24m in length and over,'' and substituting the following words in each of those subclauses: ``In every new ship of Class I, and in every new ship of Class II of 24m in length and over, and in every existing ship of Class II of 24m to 45m (inclusive) in length.'' (4) Clauses 3 (7), 4 (1), 4 (2), 4 (3), 4 (6), 5 (1) and 7 (1) of the Schedule to the principal notice are hereby amended by inserting, after the word ``every'' wherever it occurs, the word ``new''. (5) Clause 4 (7) of the Schedule to the principal notice is hereby amended by inserting, after the words ``in any'' in lines 1 and 2, the word ``new''. (6) Clauses 5 (4), 6, 9 (1), 10, 11, 12 (5) and 13 of the Schedule to the principal notice are hereby amended by deleting the words ``ship of Class I, or II'' or ``ship of Class I, or Class II'' and substituting the following words: ``new ship of Class I or II, and every existing ship of Class II of less than 45m in length''. (7) The Schedule to the principal notice is hereby amended by adding the following clause: ``14. Existing Ships (1) Existing ships of Class I, and existing ships of Class II of 45m or more in length, the keel of which was laid before 25 May 1980 shall comply with the requirements of the International Conference on Safety of Life at Sea 1960, Chapter II - Part E, Regulations 55 to 64 inclusive and Regulations 66 and 67. Where they carry more than 36 passengers they shall also comply with the requirements of the International Conference on Safety of Life at Sea 1974, Chapter II - 2, Part F, Regulations 80 (b), and 81 (c) and (d). (2) Existing ships of Class I, and existing ships of Class II of 45m or more in length, the keel of which was laid on or after 25 May 1980 but before 1 September 1984, shall: (a) if carrying more than 36 passengers, comply with the requirements of the International Conference on Safety of Life at Sea 1974, Chapter II-2, Parts B and C, Regulations 29, 30 (c) and (e), 31 (a) and (b), and 32; or (b) if carrying not more than 36 passengers, comply with the requirements of the International Conference on Safety of Life at Sea 1974, Chapter II-2, Part C, Regulation 47.''
