Application for Order to Vary a Charitable Trust In the matter of the Charitable Trusts Act, 1957, and in the matter of an application by Father Brian Jude McAloon of Stratford, trustee in respect of the Francis Ferris Trust Applicant: Take notice that the above-named applicant will apply to the High Court at New Plymouth on Friday, the 6th day of May 1994 at 10 a.m. for an order that the charitable trust set up pursuant to the provisions of the will of Francis Ferris, be varied as follows: 1. The trustees powers be extended to include the power of sale and investment of proceeds of sale and any investment authorised by law, and 2. The trust income to be applied firstly towards the educational needs of the children of the Parish of the Church of the Immaculate Conception at Stratford and who in the opinion of the trustees are in need of financial assistance, and secondly towards the educational needs of all the parishioners of the Church of the Immaculate Conception at Stratford. Any person, desiring to oppose this application must do so in writing to the Registrar of the High Court at New Plymouth, and to the trustees, whose address for service is at the offices of Gordon & Mooney, P.O. Box 190, Stratford, and to the Attorney-General. Such letters of opposition must reach the Registrar and the trustees and the Attorney-General not less than seven (7) days before the date of hearing aforementioned.
