District Anglers (Otago Fish and Game Region) Notice 1994 Pursuant to section 26r (3) of the Conservation Act 1987, the Otago Fish and Game Council hereby gives the following District Anglers Notice. N o t i c e 1. Title and Commencement This notice may be cited as the District Anglers (Otago Fish and Game Region) Notice 1994 and shall come into force on the first day of October 1994. 2. Interpretation Words and expressions in this notice which are defined in the Conservation Act 1987, or the Freshwater Fisheries Regulations 1983, shall have the meanings so defined. 3. Open Season (1) Subject to the provisions of this Notice, fishing for sports fish is permitted 24 hours per day in the season and specified waters as listed in this clause. An open season commences on the date first shown in any year and ends on the date second shown in the following year (both days inclusive). (a) Season: 1 October to 30 April: Specified waters: Nevis River. Those waters NOT specified in 3 (b) to 3 (f) below (inclusive) Nor in clause: 4. (b) Season: 1 October to 30 September: Specified waters: Butchers Dam: Catlins River, downstream from the State Highway 92 road bridge: Clutha River, except that river reach known as Deans Bank defined by a landmark post approximately 600 metres below Lake Wanaka outlet and a landmark post 600 metres above the Albert Town bridge. Coalpit Dam: Conroys Dam: Dart River, downstream from the Dart River bridge: Diamond Lake: Hawea River: Hoffmans Dam: Kawarau River: Lake Dunstan: Lake Hayes: Lake Hawea: Lake Onslow: Lake Roxburgh: Lake Waihola, including the waterways connecting this lake to lake Waipori and east on waterways to the confluence with the Taieri River: Lake Waipori: Lake Wakatipu: Lake Wanaka: Moke Lake: Molyneux Pond: Owaka River, downstream from the Pounawea/Newhaven road bridge: Phoenix Dam: Poolburn Dam: Puerua Estuary, downstream from the State Highway 92 bridge: Reid Lake: Shag River, downstream from the State Highway 1 road bridge: Taieri River, downstream from the road bridge at Allanton: Tahakopa River, downstream from the Maclennan River confluence: Tokomairiro River, downstream from Coal Gully road bridge: Tomahawk Lagoon: Waikouaiti River, downstream from the State Highway 1 road bridge: Waitati River, downstream from the Doctors Point Road bridge: Water of Leith, downstream from the Anzac Avenue bridge: (c) Season: 1 November to 30 April Specified waters: Those rivers and streams flowing into Lake Mahinerangi. All rivers and streams flowing into Lake Dunstan, NOT being waters specified in 3 (b). (d) Season: 1 December to 31 May Specified waters: Timaru Creek: (e) Season: 1 November to 31 May Specified waters: Ross Creek Reservoir: Rossville Reservoir: Southern Reservoir: Sullivans Dam: Upper Manorburn Dam All rivers and streams flowing into all lakes in the Clutha River catchment upstream from the Clyde Dam NOT being waters specified in 3 (c) and 3 (d). (f) Season: 1 October to 31 May Specified waters: Diamond Creek: Lake Mahinerangi: All other waters in the Clutha River catchment upstream from the Clyde Dam NOT specified elsewhere in clause 3. (2) No person shall fish for, take or attempt to take, any sports fish except during an open season. 4. Closed Season (1) Fishing for sports fish is not permitted at any time in the following specified waters: Bullock Creek From Lake Wanaka to source: Careys Creek, within 100 metres of any part of the outer boundaries of Bartlett's salmon farm diversion structure: Horne Creek, from Lake Wakatipu to source: Lake Wanaka, within 150 metres of any part of the launch wharf at the township of Wanaka: Lake Wanaka, within 100 metres of any part of the wharf at the Wanaka Marina: Lake Wakatipu, within the waters of Queenstown Bay bounded by a straight line drawn from the outermost point of the Tourist Park to the point where the south bank of One Mile Creek meets Lake Wakatipu: Lake Wakatipu, within 100 metres of any part of the wharf in Black Bay (commonly known as the Walter Peak Jetty): Mill Creek (which flows into Lake Hayes), from the Speargrass Flat Road bridge to the source: Roxburgh Dam upstream of the posts marked ``Fishing prohibited above this point'' placed on each side of the Clutha River at the spillway from the Roxburgh power-house: Waipori No. 3 Dam on the Waipori River adjacent to Waipori township: All waters in which sports fish are held in captivity for display, hatching, or other purposes, or within a distance of 100 metres from any part of the outer boundaries of such waters. 5. Authorised Tackle (1) Fishing for sports fish is not permitted except by using one rod and running line, provided that when playing a sports fish, a landing net or gaff may be used to secure or land any such fish. (2) No person shall, when fishing for sports fish, use or be in control of, more than one assembled rod and running line at any one time. (3) No person shall fish for sports fish unless within 15 metres of the rod being used, and with the rod under that person's visual observation. 6. Restriction on Lures, Baits and Areas (1) Subject to subclause (2), (3), (4), (5) and (6) of this clause, authorised lures and baits are any natural or artificial: fly, worm, crustacean, frog, mouse, insect, minnow or fish (excluding fish ova or any portion of a fish or any shellfish mollusc, provided that the shell of any mollusc may be used in the preparation of an artificial minnow). (2) No person when fishing for sports fish shall use (a) More than 2 lures or baits: (b) Any bait or lure treated with any chemical preparation other than; (i) In the case of artificial fly, preparations used solely to give buoyancy to such flies: and; (ii) In the case of natural baits, a formalin or other preservative preparation: (c) On or in conjunction with any fly, minnow, or other lure, any single, double, or treble hook, any one hook of which has a greater distance than 13 mm between the point and the nearest part of the shank of the hook. (d) In any waters in which only artificial fly is permitted, any wooden or plastic bubble with or without water, or weight other than the necessary weight of line to cast any artificial fly. (3) No person when fishing for sports fish shall use any lure or bait other than natural or artificial fly in the following waters: (a) Deans Bank, meaning that portion of the Clutha River lying downstream between a point indicated by a Black and Yellow landmark post approximately 600 metres from the outlet of Lake Wanaka, and a point indicated by a Black and Yellow landmark post, approximately 600 metres above the bridge at Albert Town. (b) All rivers and streams flowing into Lake Wakatipu, except the Dart River and the Rees River and their tributaries. (c) Nevis River. (4) Subject to subclause (5), no person when fishing for sports fish shall use any lure or bait other than artificial fly or lure in the following waters: (a) Clutha River catchment upstream from Lake Dunstan; (b) Ross Creek Reservoir; (c) Rossville Reservoir; (d) Sullivans Dam; (e) Southern Reservoir; (5) Notwithstanding the above all methods are permissible in the following waters: (a) Clutha River, from Luggate Bridge to Lake Dunstan; (b) Lake Hayes and all streams flowing into or out of; Lake Hawea; (d) Lake Johnson; (e) Kawarau River; (6) All methods are permissible in all other waters within the region other than (3) & (4). 7. Prohibition on Unauthorised Fishing Tackle, etc. No person shall, when fishing for sports fish, use or be in possession or control of, or convey or cause to be conveyed to the vicinity of any place where that person is fishing or proposes to fish, any stroke-hauling or foul-hooking gear, or any spear. 8. Restrictions on Use of Boats (1) No person shall fish from a boat on Lake Kirkpatrick. (2) Subject to subclause (3) of this clause, no person shall troll from a mechanically propelled boat within 100 metres of any person fishing from the shore. (3) No person in fishing for sports fish shall troll from any boat in any river or stream except the Taieri River downstream from Henley Ferry bridge, and the Clutha River downstream from Balclutha. 9. Daily Limit Bag (1) Except in the case of perch for which there is no daily limit, no person shall on any one day take and kill or be in possession of more than the prescribed daily limit from the following specified waters: Specified waters (a) Lochy River special catch and release zone (being that portion of the river from its source to its confluence with the Longburn), Routeburn River; Daily Limit: Nil. Sports fish caught within these waters must be immediately released into the water from which it has been taken. (b) Rivers and tributaries flowing into any of the lakes Hawea; Wanaka; and Wakatipu (but excluding the special catch and release zones); Nevis River; Ross Creek Reservoir; Rossville Reservoir; Southern Reservoir; Sullivans Dam; and Von Lake: Daily Limit: No more than one sports fish per day. (c) Blakelys Dam; Coalpit Dam; Diamond Lake; Fraser River (Upper); Hoffmans Dam; Lake Johnson: Lake Kirkpatrick; Mathias Dam; Pomahaka River upstream from Park Hill Bridge; Reid Lake; Rutherfords Dam; and Tomahawk Lagoon: Daily Limit: No more than three sports fish per day. (d) Elsewhere in Otago Region other than 9 (a), (b), (c) and (d), and down stream of the Roxburgh Dam and all coastal rivers. Daily limit: No more than two salmon. (2) Subject to the restrictions set out in 9 (1) above, no person shall on any one day take or kill or be in possession of more than six sports fish per day. 10. Minimum Size to be Taken (1) No person shall take or be in possession of any trout or salmon which does not exceed in length; (a) In the case of any trout taken from the Water of Leith, Teviot River, Lake McKellar and Lake Sylvan, 20 cm. (b) In the case of salmon taken from the Water of Leith, 45 cm. (c) In the case of trout or salmon taken from any other water, 25 cm. (d) In the case of perch, no size limit. (2) Every person taking a trout or salmon which does not exceed the specified length shall immediately return it with as little injury as possible into the water from which it was taken. 11. Revocation The notice published in the supplement to the Gazette, No. 129, of Thursday, 29 August 1992, on pages 27902792 titled District Anglers (Otago Fish and Game Region) Notice 1991, and amendments No. 1, No. 2 and No. 3 are revoked as from midnight 30 September 1994.
