District Anglers (North Canterbury Fish and Game Region) Notice 1994 Pursuant to section 26r (3) of the Conservation Act 1987, the North Canterbury Fish and Game Council hereby gives the following District Anglers Notice. N o t i c e 1. Title and commencement This notice may be cited as the District Anglers (North Canterbury Fish and Game Region) Notice 1994 and shall come into force on the 1st day of October 1994. 2. Interpretation (1) Words and expressions in this notice which are defined in the Conservation Act 1987, or the Freshwater Fisheries Regulations 1983, shall have the meaning so defined. (2) In this notice the term ``high country waters'' means Lakes Lilian, Coleridge, Selfe, Evelyn, Grace, Henrietta, Ida, Little Ida, Catherine (also known as Monck), Georgina, Spectacles, Red Lakes, Lyndon Tarn, Lyndon, Rubicon, Pearson, Grasmere, Sarah, Hawdon, Marymere, Vagabonds Inn Tarn, Blackwater, Letitia, Minchin, Sheppard, Taylor, Katrine, Sumner, Mason, and Guyon, and all waters flowing into those lakes; and includes all other lakes and tarns laying west and north of a line joining (a) The white posts on the south bank in general line with the Lake Coleridge powerhouse intake pipes on the north bank, on the Rakaia River; and (b) The white posts at Woodstock on the Waimakariri River; and (c) The junction of the Hurunui River with the South Branch; and (d) The junction of the Waiau and Hope Rivers. (3) ``Taking'' means fishing and ``takes'' and ``to take'' have a corresponding meaning. (4) ``Sportsfish'' means every species of freshwater fish that the Governor- General may declare by order in Council to be sportsfish, and includes all trout, salmon, brook trout, mackinaw, splake, perch and tench, and any hybrids and their young. 3. Open season (1) Subject to subclause (2) and (3) of this clause and to clause 4 of this notice, there shall be an open season for fishing for sports fish from the 1st day of October in any year to the 30th day of April in the following year (both days inclusive). (2) In addition to (1) hereof there shall be an open season for fishing for sports fish from the first Saturday after Queen's Birthday Weekend to the 31st day of August in the same year (both days inclusive) in the following waters: (a) The Waiau River downstream from its junction with the Hope River: (b) The Hurunui River downstream from its junction with the South Branch: (c) The Ashley River downstream from the State Highway No. 1 bridge: (d) The Waimakariri River downstream from the white posts at Woodstock: (e) The Selwyn River downstream from where the South Springston Road meets the river at the upstream end of the Upper Selwyn Huts: (f) Lake Forsyth, and the Wairewa and Okuti Rivers downstream from the road bridge over each river on the Little River-Te Oka Bay road: (g) Lakes Taylor, Sumner, Coleridge, Lyndon, and Selfe, except within 200 m of any stream flowing into those lakes: (h) The Rakaia River downstream from the bridge on the main South Road. (i) At sea off the Tentburn Hatchery outside 100 metres from the hatchery outfall. (3) Avon and Heathcote Rivers: In addition to clause 3 (1) hereof there shall be an open season for fishing for sports fish from the 1st day of October in any year to the 30th day of September in the following year (both days inclusive) in the Heathcote River and the Avon River, except as provided in clause 4 (1) (d), clause 4 (1) (e) and clause 4 (3) of this notice. (4) No licence holder shall fish for, take or attempt to take, any sports fish except during an open season. 4. Closed season (1) Nothwithstanding clause 3 hereof, there shall be a closed season for fishing for sports fish (a) From the 1st day of October 1994 and ending on Friday, the 4th day of November 1994 (both days inclusive) in any high country waters: (b) From midnight on Friday, the 4th day of November 1994 until midnight on the 30th day of November 1994 (both days inclusive) in any natural or artificial stream and tributary flowing into any high country lake. (c) From the 1st day of March to the 30th day of April in the same year (both days inclusive) in the Rakaia River and its tributaries above the Lake Coleridge powerhouse, that point more particularly shown by white posts on the south bank in general line with the powerhouse intake pipes on the north bank; provided that this subclause shall not apply to any lakes draining in to the Rakaia River above the point specified; (d) From the 1st day of April to the 30th day of April in any stream and tributary flowing into any high country lake whether artificial or natural; (e) From the 1st day of October in any year to the 30th day of September in the following year (both days inclusive) in Taylor's Drain from its source to its junction with the Wairarapa Stream; in the Avon River from the Armagh Street bridge at Hagley Park to the Barbadoes Street bridge; and in the Avon River and its tributaries entering it above the Armagh Street bridge for senior (adult) licence holders only; and in Lake Marion in the Lake Sumner Forest Park. (f) From the 1st day of May in any year to the 30th day of September in the same year (both days inclusive) in the Avon River and its tributaries above the Barbadoes Street bridge to the source; and in the Heathcote River and its tributaries above the Malcolm Avenue bridge to the source. (g) From the 1st day of February to the last day of February in the same year (both days inclusive) in the Glenariffe Stream upstream from the points marked and signposted, which are located 160 metres downstream from the hatchery release race outfall, to the Road Bridge above the hatchery. (2) Notwithstanding clause 3 hereof, there shall be a closed season for fishing for quinnat salmon from the 1st day of March to the 30th day of April in the same year (both days inclusive) in the following waters: (a) The Hurunui River above the junction of the South Branch of that river, or any tributary of that part of that river, including Lake Sumner: (b) The Waiau River above the junction of that river with the Hope River, or any tributary of the Waiau River: (c) The Waimakariri River above the white posts at Woodstock, or any tributary of that part of that river or the Kowai River and its tributaries including Hacketts Creek. (3) Notwithstanding clause 3 hereof, there shall be a closed season for fishing for quinnat salmon from the 1st day of March to the 30th day of September in the same year (both days inclusive) in the Avon, and Heathcote, rivers. 5. Authorised tackle (1) No licence holder shall fish for, take or attempt to take, any sports fish except by using a rod and running line. (2) Notwithstanding subclause (1) of this clause, (a) When playing a sports fish, a landing net or gaff may be used to secure or land any such fish; (b) For keeping sports fish alive, a keep net of not more than 1.8 metres in length may be used in the water from which that fish was taken. (3) No licence holder shall have, in fishing for, taking or attempting to take, sports fish, or have under his or her control, more than one assembled rod and running line. (4) No licence holder shall fish for sports fish unless within 15 metres of the rod being used and has the rod under visual observation. (5) No licence holder when fishing for sports fish shall use: (a) More than 2 lures or baits; (b) Any lead or weight attached below or so as to hang below any lure or bait; (c) In any water in which only artificial fly fishing is permitted, any additional lead or weight other than the necessary weight of line, cast and fly; (d) Any artificial fly having more than one hook or having a multiple hook; (e) Any bait or lure treated with any medicinal or chemical preparation other than; (i) In the case of artificial fly substances used solely to give buoyancy to such flies; and (ii) In the case of natural baits, a formalin or other preservative preparation; (f) Any wire, either plain or twisted, or any gimp trace or cast of a greater thickness than 0.82 mm; (g) Any wire or gimp trace or cast of a greater length than 1.8 metres. (h) On or in conjunction with any fly, spoonbait, minnow, or other lure any double or treble hook or other fixed multiple assembly of hooks any one hook of which has a greater distance than 13 mm between the point and the nearest part of the shank of the hook; (i) In conjunction with any spoonbait or artificial minnow, any lead or weight affixed to the trace or line at a distance of less than 38 cm above the lure; (j) Any unsportsmanlike device or method. (6) Notwithstanding subclause (5) of this clause, no licence holder in fishing for sports fish shall (a) Use any natural lure or bait in any high country waters: (b) Fish from any boat being mechanically propelled in any lakes except in lakes Ellesmere, Forsyth, Coleridge, and Sumner at a distance of at least 200 m from any person fishing from the shore: (c) Fish from any boat or flotation device in any high country waters except Lakes Coleridge, Georgina, Lyndon, Pearsons, Taylor, Katrine, and Sumner, in which lakes any boat that is not being mechanically propelled may be used; (d) Use any lure or bait other than artificial fly in Lakes Ida, Little Ida, Catherine (also known as Monck), Sarah, Marymere, or Sheppard: (e) During the period commencing on the 1st day of January and ending with the 30th day of April in any year (both days inclusive), use in the Rakaia River more than one lure or bait when any weight is attached. (7) Notwithstanding subclauses (5) and (6) of this clause, any licence holder who, when using a line with weight attached other than the normal weight of the lure, bait, or fly, hooks a fish other than through the head (defined as those portions of a vertical line immediately behind the operculum of the gills to the snout) shall immediately return the fish alive with as little injury as possible into the waters from which it was taken. 6. Prohibition on Unauthorised Fishing Tackle, etc. Subject to subclause 5 (2) of this Notice no licence holder shall, when fishing for sports fish, use or be in possession of, or be in control of, or convey or cause to be conveyed to the vicinity of any place where that licence holder is fishing or proposes to fish, any paravane, any stroke-hauling or foulhooking gear, or any spear, or any gaff. 7. Use of nets Subject to clause 5 (2) of this notice, no licence holder shall use or cause to be used for taking sports fish a net of any description: Provided that it shall be a defence for any licence holder charged with a breach of this clause if that licence holder proves that he or she was netting for indigenous fish in accordance with the provisions of any regulations or notices in force in that behalf. 8. Prohibition on possession or control of spear gun (1) No licence holder shall, when taking or attempting to take or when in possession of, any sports fish, be in possession of or be in control of, any spear gun or any pointed missile (other than a bullet) which is propelled by means of any mechanical or explosive device. (2) Where any licence holder is charged with an offence under subclause (1) of this clause, it shall be a defence to the charge if the defendant proves that the speargun or pointed missile in the defendant's possession or under the defendant's control was not used in the taking of the sports fish. (3) In this clause the term ``explosive'' has the same meaning as in the Explosives Act 1957. 9. Authorised lures and baits No licence holder shall fish for sports fish with any bait or lure other than artificial or natural fly, insect, worm, crustacea, minnow, fish (excluding fish ova or any portion of a fish or any shellfish (mollusca)). 10. Daily limit bag (1) No licence holder shall on any one day take, kill or have in possession more than 6 sports fish. (2) Notwithstanding subclause (1) of this clause, no licence holder shall on any one day take or have in his possession more than: (a) 6 sports fish taken from Lake Coleridge of which no more than 4 shall be trout; (b) 2 quinnat salmon taken from any other water; (c) 4 trout taken from any other water. (d) 1 splake from Lake Letitia. (3) No licence holder shall continue to fish for sports fish on any day on which he has already killed 6 sports fish. (4) It shall be permissible to make up the difference between a lesser limit bag prescribed in one place and a higher limit bag prescribed in another place. (5) Notwithstanding subclauses (1), (2) and (4) of this clause, no licence holder shall on any one day take and kill or have sports fish in their possession, from: (a) Lake Marymere (a special catch and release zone); all sports fish caught in this water must be immediately released with as little injury as possible back into the waters from which they were taken. 11. Minimum size to be taken (1) No licence holder shall take or have in his possession any trout or salmon which does not exceed 25 cm in length. (2) Every licence holder taking a trout or salmon which does not exceed the specified length, or who wishes to release the fish for whatever reason, shall immediately return it with as little injury as possible into the water from which it was taken. 12. Revocation The notice published in the supplement to the Gazette, 1990, No. 151, pages 32133215 titled District Anglers (North Canterbury Fish and Game Region) Notice 1990, and Amendments No. 1, No. 2, No. 3 and No. 4, are hereby revoked.
