Notice of Application to Approve a Scheme

Take notice that on Wednesday 26 September 2019, an application for orders approving a scheme prepared under Part 3 of the Charitable Trusts Act 1957 was filed in the High Court at Nelson in relation to a charitable trust created by a conveyance of land from William Cullen to the predecessors of The Presbyterian Church Property Trustees.

The charitable trust relates to the Trinity Presbyterian Church in Nelson, in particular the property described as Section 500 City of Nelson (Identifier NL57/32).

The application is to be heard before the High Court at Nelson on Wednesday 4 December 2019 at 10.00am.

Any person who wants to oppose the scheme must, not less than seven clear days before the hearing date, give written notice of their intention to do so to

  1. the Registrar of the High Court at Nelson;
  2. The Presbyterian Church Property Trustees; and
  3. the Attorney-General.

The purpose of the charitable trust was to provide land in perpetuity for the Trinity Presbyterian Church. The scheme proposes to amend that purpose so that The Presbyterian Church Property Trustees may sell the land and use the proceeds to further the Presbyterian Church of Aotearoa New Zealand’s mission within the Presbytery that encompasses the City of Nelson.
