Notice of Exemption From Maritime Rules and Marine Protection Rules

Pursuant to sections 47(3) and 395(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting of the following exemptions from the Maritime and Marine Protection Rules for the period 7 December 2018 to 7 January 2019 inclusive:

  • 1 from Rule 25.4(1)(b)(iv)–(v) – Nautical Charts and Publications – Area requirements – Nautical publications like notices to mariners and an astronomical almanac must be carried on the vessel
  • 1 from Rule 25.4(1)(c) – Nautical Charts and Publications – Area requirements – Mathematical tables for the calculation of astronomical observations must be carried on the vessel
  • 1 from Rule 31.25(1) – Crewing and Watchkeeping – General crewing and other requirements – Duty of crew to hold certificates and to be able to demonstrate ancillary proficiencies – Specific certificate or endorsement or higher grade of certificate or endorsement
  • 1 from Rule 31.82(1) – Crewing and Watchkeeping – Requirement to operate under Minimum Safe Crewing Document for some ships – Only in relation to the requirement to operate with Qualified Deck Crew (QDC)
  • 1 from Rule 31.84(2)(b)(i) – Crewing and Watchkeeping – Ships other than ships to which subparts C and D apply – Minimum crewing requirements for other ships – Seafarers on board hold minimum requirement certificates and prescribed endorsements

  • 1 from Rule 40A.23(3) – Design, Construction and Equipment – Passenger Ships which are not SOLAS Ships – Watertight integrity – Positioning requirements of portlights in the side of the ship below the freeboard deck
  • 1 from Rule 40A.24(1)(b) – Design, Construction and Equipment – Passenger Ships which are not SOLAS Ships – Weathertight integrity – Minimum height requirements of coaming or sill
  • 1 from Rule 40C.13(1), Appendix 1, 1.2(4) – Design, Construction and Equipment – Non-Passenger Ships that are not SOLAS Ships – Intact stability of post-27 May 2009 fully decked ship – Must be determined from results of an inclining experiment
  • 1 from Rule 40C.13(4) – Design, Construction and Equipment – Non-Passenger Ships that are not SOLAS Ships – A ship that is engaged in towing operations must be a decked ship and meet the intact stability requirements of Appendix 1
  • 1 from Rule 40C.18(3) – Design, Construction and Equipment – Non-Passenger Ships that are not SOLAS Ships – Watertight integrity – Positioning requirements of portlights in the side of the ship below the freeboard deck

  • 1 from Rule 45.5(1) – Navigational equipment – All New Zealand ships – Sextant, chronometer, and binoculars – Ships proceeding beyond unlimited area must be provided with at least one sextant
  • 1 from Rule 45.27(1) – Navigational Equipment – Ships of 500 tons gross tonnage or more to which SOLAS is not applied – Requirements for fishing ships to be fitted with gyro-compasses
  • 1 from Rule 47.60 – Load Lines – Ships of less than 24 metres in length – Compliance with section 2 – Owner and master of ship must not allow ship to proceed on a voyage unless it is surveyed and maintained
  • 1 from Rule 50.9(1) – Medical Stores – Scale 4 – Rule 50.9 applies to any ships operating in the unlimited area
  • 1 from Rule 82, Appendix 1, section 1.12(c) – Commercial Jet Boat Operations (River) – Operating details, procedures, and programmes to be included in Commercial Jet Boat Safe Operational Plan – Navigational safety – Commercial jetboats must keep to right unless safety otherwise dictates
  • 1 from Rule 82, Appendix 2, section 2.14.4(a) – Commercial Jet Boat Operations (River) – Fixed fire extinguishing systems must be capable of discharging into the engine space 1.5 litres, per nozzle, per 1.5 cubic metres of net engine space
  • 1 from Rule 82.41(1), Appendix 2, section 2.17.1 – Commercial Jet Boat Operations (River) – Commercial jet boat standards – Personal flotation devices – Each person on board must be provided with a personal flotation device
