Notice Pursuant to Section 70 of the Land Transfer Act 1952

The applicant described below has applied under section 70 of the Land Transfer Act 1952 for the removal of a right of way, right to convey electric power and telephone communications easement. The applicant claims the right of way, right to convey electric power and telephone communications easement is redundant by reason of the circumstances set out below.

I intend to remove the right of way, right to convey electric power and telephone communications easement on 23 August 2018 if no objections have been received before that date.

Easement: A right of way, right to convey electric power and telephone communications easement over parts Lot 1 DP 17544 marked “A” and “B” on DP 19308 appurtenant to Lots 3–12 DP 506130 and a right of way easement over parts Lot 1 DP 17544 marked “A” and “B” on DP 19308 appurtenant to Lot 1 DP 506130 created by Transfer 472012.2 – 23 January 1987 at 10.35am.

Circumstances: The dominant land has become physically separated from the servient land as a result of the subdivision of plan DP 506130.
