Land Transfer Act Notice

An application under section 70 of the Land Transfer Act 1952 has been received for the removal of an easement.

The applicants claim the easement is redundant by reason of the circumstances set out below.

Easement: Right of Way over part Lot 1 DP 413113 marked “Aa” on DP 413113 and part Lot 7 DP 413113 marked “G” on DP 413113 comprised in Computer Register 448742 and over part Lot 2 DP 413113 marked “Ba” on DP 413113 and part Lot 5 DP 413113 marked “E” on DP 413113 comprised in Computer Register 448743 and over part Lot 3 DP 413113 marked “Ca” on DP 413113 and part Lot 6 DP 413113 marked “F” on DP 413113 comprised in Computer Register 448744 and over part Lot 4 DP 413113 marked “Da” on DP 413113 comprised in Computer Register 448745 in favour of Lot 1 DP 489358 comprised in Computer Register 703973 and created by Easement Instrument 7956478.3 registered on 3 October 2008.

Circumstances: The dominant tenement has become physically separated from the servient tenements as a result of the subdivision shown on DP 489358.
