Radiocommunications Regulations (General User Radio Licence for Maritime Purposes) Notice 2016

Pursuant to Regulation 9 of the Radiocommunications Regulations 2001 (“Regulations”) made under section 116(1)(b) of the Radiocommunications Act 1989 (“Act”), and acting under delegated authority from the chief executive, I give the following notice.

Notice

1. Short title and commencement—(1) This notice is the Radiocommunications Regulations (General User Radio Licence for Maritime Purposes) Notice 2016.

(2) This notice came into force on 1 October 2016.

2. Licence

(1) Licence Name: General User Radio Licence for Maritime Purposes.
(2) Licence: Any person may transmit radio waves using radio devices for the purpose of maritime radiocommunications, in accordance with the applicable terms, conditions and restrictions of this notice.
(3) Licence number: 254943
(4) Commencement date: 1 October 2016.

4. Location

(1) Transmit Location: All New Zealand.
(2) Receive Location: All New Zealand.

5. Special conditions

  1. Use is limited to distress and safety communications using narrow-band direct-printing telegraphy (NBDP-COM).
  2. Use is limited to distress, safety and calling communications using radiotelephony (RTP-COM).
  3. Use is limited to distress and safety communications using digital selective calling (DSC).
  4. Use is limited to distress and safety communications using radiotelephony while engaged in coordinated search and rescue operations with aeronautical stations.
  5. Use is limited to radiocommunications with harbour authorities.
  6. Use is limited to supplementary calling frequency.
  7. Use is limited to inter-ship communications.
  8. Use is limited to temporary aquatic sporting events.
  9. Use is limited to communications with the Maritime New Zealand coast station.
  10. Use is limited to communications with private coast stations.
  11. Use is limited to duplex communications with coast stations.
  12. Use is limited to international calling.
  13. Use is limited to maritime repeater.
  14. Use is limited to anti-pollution operation.
  15. Use is limited to port operations and ship movements.
  16. Use is limited to surf lifesaving clubs.
  17. Use is limited to inter-ship navigation safety.
  18. Use is limited to marinas.
  19. The channels in band 156.2875 – 156.3125 MHz may also be used by aircraft for the purposes of search and rescue communications.
  20. The channels in bands 156.4375 – 156.4625 MHz and 156.6625 – 156.6875 MHz may also be used by light aircraft and helicopters to communicate with ships or coast stations in predominantly maritime support operations.
  21. Use is limited to diving operations.
  22. Use is limited to Automatic Identification System (AIS).
  23. Use is limited to maritime radionavigation radar.
  24. Use is limited to radio buoys operating for the purposes of locating nets, long-lines, pots and other materials.
  25. Use is limited to ship earth stations in the Mobile Satellite Services (MSS).
  26. Use is limited to earth stations on board vessels (ESV) in the Fixed Satellite Service (FSS).
  27. Use is limited to earth stations on board vessels operating in accordance with the class of station ‘earth station in motion’ as defined in the International Radio Regulations.

6. General conditions applying to all transmissions under this licence

  1. Except as provided for in subsection (2), a person may, in accordance with the provisions of the Schedules to this notice, operate radio transmitters in the maritime service, including land and aeronautical transmitters, for the purposes of:
    1. the safe and expeditious conduct of maritime transportation;
    2. an emergency;
    3. a matter that relates to the particular occupation, industry or activity in which a marine craft is engaged; or
    4. providing telecommunications services to passengers of marine craft.
  2. This licence does not include:
    1. land-based transmitters, including coast stations, operating on frequencies below 30 MHz;
    2. remotely activated private and public coast stations;
    3. maritime VHF repeater transmitters; or
    4. remote activation of a maritime VHF repeater by a land station without the express permission, pursuant to Regulation 13 of the Regulations, of the maritime VHF repeater licensee.
  3. In accordance with the provisions of Articles 19 and 47 of the International Radio Regulations, a person operating a maritime service transmitter must:
    1. use the maritime identification allocated in accordance with the Regulations; and
    2. be the holder of an applicable certificate of competency issued in accordance with the Regulations.
  4. In accordance with the provisions of the First Schedule to the Act, a person operating a transmitter pursuant to this licence must also comply with all relevant provisions of the Maritime Transport Act 1994, and regulations and rules made under that Act.
  5. Transmitters must conform to technical standards as prescribed in notices made under Regulation 32(1)(b) of the Regulations.
  6. Frequency use is on a shared basis and the chief executive does not accept liability under any circumstances for any loss or damage of any kind occasioned by the unavailability of frequencies, or interference to reception.
  7. Should interference occur to services licensed pursuant to a radio licence or a spectrum licence, the chief executive reserves the right to require and ensure that any transmission pursuant to this General User Radio Licence change frequency, reduce power or cease operation.
  8. A person, authorised by the chief executive, shall be granted at all reasonable times entry to any premises, building, aircraft, ship, carriage, vehicle, box or receptacle for the purposes of ensuring compliance with this licence.
  9. Words and expressions that are defined in:
    1. the Radiocommunications Act 1989, and Regulations and notices made under that Act;
    2. the International Radio Regulations annexed to the International Telecommunications Convention; and
    3. the International Convention for the Safety of Life at Sea (SOLAS)
    have the meanings so defined.
  10. Frequencies designated for International Distress, Safety and Calling may also be used by aircraft for search and rescue communications.

7. Consequential revocation of licence—(1) The Radiocommunications (General User Radio Licence for Maritime Purposes) Notice 2007, dated 26 October 2007 and published in the New Zealand Gazette, 1 November 2007, No. 118, page 3104, is revoked.

(2) Notwithstanding the revocation of the notice under subsection (1), every transmitter capable of making transmissions compliant with the requirements of that notice on the commencement date of this notice is deemed to be compliant with the requirements of this notice.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice:

  • amends the provisions in the VHF bands as a result of the recent changes to Appendix 18 of the International Radio Regulations to enable wideband digital communications and further capacity for ship tracking;
  • expands the provision for earth stations on board vessels (ESV) to operate in the 14 – 14.5 GHz range (formerly 14 – 14.25 GHz), and also removes the restriction on elevation angle in order to allow a greater angle of transmission from an ESV; and
  • amends the provision for maritime radionavigation radars in the 5470 – 5650 MHz range (formerly 5470 – 5850 MHz) to reflect the typical shipborne radar applications that are permissible in New Zealand.
