HAMILTON RESIDENTIAL TRUST

Application for Approval of a Scheme to Vary Trust Deed Pursuant to the Charitable Trusts Act 1957 and an Order Under Section 64(1) of the Trustee Act 1956

Take notice that on 27 September 2016 the trustees of the HAMILTON RESIDENTIAL TRUST (“trustees”) filed an application in the High Court at Hamilton for approval of a scheme varying the Deed of Trust for the HAMILTON RESIDENTIAL TRUST dated 22 May 1991 (“trust deed”).

The scheme proposes variation of the trust deed regarding its objects so that the trustees may make donations and distributions to other organisations that are exclusively charitable and with purposes similar to the HAMILTON RESIDENTIAL TRUST.

The scheme further proposes to vary the trust deed regarding the trustees’ ability to make future amendments to the trust deed.

The trustees further apply for an order under section 64(1) of the Trustee Act 1956 to authorise prior distributions that the trustees have made to the HRT Property Holdings Trust.

The application is to be heard before the High Court at Hamilton on 8 February 2017 at 9.30am.

Any person who wishes to oppose the variation or the order sought under section 64(1) of the Trustee Act 1956 must give seven days’ notice in writing of his or her intention to do so, to:

  1. the Registrar of the High Court at Hamilton; and
  2. the Attorney-General, Crown Law Office, PO Box 2858, Wellington 6140 (attention: Alison Todd/Matt McKillop).
