Notice of Direction to Require Screening

Pursuant to section 77B of the Civil Aviation Act 1990, this notice replaces and rescinds the previous Notice of Direction dated 6 July 2011 and published in the New Zealand Gazette, 14 July 2011, No. 105, page 3075.

Believing on reasonable grounds that a security risk exists, I direct the Aviation Security Service as follows:

Interpretation

For the purposes of clarity, the following definitions apply:

Carry-on baggage means baggage and any other item that:

      1. is carried on to an aircraft by a passenger or crew member with the agreement of the operator; and
      2. remains in the custody of the passenger or crew member.

Hold baggage means baggage placed in the hold of the aircraft.

Maximum certificated passenger seating capacity for the purpose of this notice means the maximum passenger seating capacity according to the relevant Type Certificate Data Sheet for a particular aircraft type.

Part I – Passenger, Crew and Carry-on Baggage Screening

  1. In accordance with sections 77B(1)(a) and 77B(1)(b) of the Civil Aviation Act 1990, I hereby direct the Aviation Security Service to screen, and undertake reasonable searches if necessary, of all persons boarding an aircraft with the intention to travel as a passenger or crew member, and any carry-on baggage to be carried, on an aircraft with a maximum certificated passenger seating capacity of more than ninety seats, being operated as an air transport operation within New Zealand.
  2. The screening referred to in paragraph 1 of this Part is not required if the Director of Civil Aviation directs in writing that screening is unnecessary in particular circumstances.
  3. Screening and searching in paragraph 1 of this Part mean screening and searching for the items specified in Schedule A to this notice.

Part II – Hold Baggage Screening

  1. In accordance with sections 77B(1)(a) and 77B(1)(b) of the Civil Aviation Act 1990, I hereby direct the Aviation Security Service to screen, and undertake reasonable searches if necessary, of all hold baggage intended to be carried on an aircraft with a maximum certificated passenger seating capacity of more than ninety seats, being operated as an air transport operation within New Zealand.
  2. The screening referred to in paragraph 1 of this Part is not required if the Director of Civil Aviation directs in writing that screening is unnecessary in particular circumstances.
  3. Notwithstanding the requirements of the Screening Direction issued pursuant to section 77B of the Civil Aviation Act 1990 on 11 July 2012, screening and searching in paragraph 1 of this Part means screening and searching for the items specified in Schedule B to this notice.

Schedule A

The screening and searching referred to in Part I, paragraph 1 of this notice means screening and searching for:

  1. guns, firearms and other devices that discharge projectiles designed to cause serious injury by discharging a projectile, or capable of being mistaken for such devices, including:
    • firearms of all types, including pistols, revolvers, rifles and shotguns;
    • toy guns, replicas and imitation firearms capable of being mistaken for real weapons;
    • component parts of firearms (excluding telescopic sights);
    • compressed air and CO2 guns, including pistols, pellet guns, rifles and ball bearing guns;
    • signal flare pistols and start pistols;
    • bows, crossbows and arrows;
    • harpoon guns and spear guns;
    • slingshots and catapults;
  2. stunning devices designed specifically to stun or immobilize, including:
    • devices for shocking, such as stun guns, (eg tasers) and stun batons;
    • animal stunners and animal killers;
    • disabling and incapacitating chemicals, gases and sprays, such as mace pepper or capsicum spray, tear gas, acid sprays and animal repellent sprays;
  3. objects with sharp points or sharp edges capable of being used to cause serious injury, including:
    • items designed for chopping, such as axes, hatchets and cleavers;
    • ice axes and ice picks;
    • razor blades, box cutters;
    • knives with blades of more than 6cm;
    • scissors with blades of more than 6cm as measured from the fulcrum;
    • martial arts equipment with sharp points or sharp edges;
    • swords and sabres;
  4. workers’ tools capable of being used to cause serious injury or to threaten the safety of aircraft, including:
    • crowbars;
    • drills, drill bits in excess of 6cm, and cordless portable power drills;
    • tools with blades or shafts more than 6cm capable of being used as weapons, such as screwdrivers and chisels;
    • saws, including cordless power saws;
    • blow torches;
    • bolt guns and nail guns;
  5. blunt instruments capable of being used to cause serious injury when used to hit, including:
    • baseball, softball and cricket bats;
    • didgeridoos;
    • clubs and batons, including billy clubs, blackjacks and nightsticks;
    • martial arts equipment;
  6. explosives and incendiary substances and devices capable of being used to cause serious injury or threatening the safety of aircraft, including:
    • ammunition;
    • blasting caps;
    • detonators and fuses;
    • replica or imitation explosive devices;
    • mines, grenades and other explosive military stores;
    • pyrotechnics, including fireworks;
    • smoke-generating canisters or cartridges; and
    • dynamite, gunpowder and plastic explosives.

Schedule B

The screening and searching referred to in Part II, paragraph 1 of this notice means screening and searching for any explosive substance or device of any kind that could be used to endanger the safety of the aircraft or of persons on board the aircraft.
