Notice of Appointment of Receiver of Income
Pursuant to Section 6 of the Receiverships Act 1993
Kiwibank Limited ("the mortgagee") is the mortgagee under Memorandum of Mortgage 7165087.3 (North Auckland Land Registry) dated the 15th day of December
2006 ("the mortgage") given by C G PARK LIMITED
("the mortgagor") in favour of the mortgagee and
affecting the land in Certificates of Title NA23C/366
and NA1543/76 (both North Auckland Land Registry), being the property known as 46-50 Broadway, Papakura, Auckland ("the land").
The mortgagor is in default under the mortgage and the mortgagee is entitled to appoint a receiver of the income of the land or any part of it, upon such default.
The mortgagee hereby appoints Timothy Wilson Downes and David Ian Ruscoe, of Grant Thornton, to be receivers
and managers of the income of the land with all the powers conferred upon a receiver in terms of the mortgage and by the law.
The receiver shall at all times be the agent of the mortgagor and not of the mortgagee.
