Notice of Recommendation Concerning the Electricity Governance Rules 2003 – Rule Amendment Proposal No. 132, 2008

1. This notice of a recommendation concerning the Electricity Governance Rules 2003 (“Rules”), Rule Amendment Proposal No. 132, 2008, is issued by
the Electricity Commission (“Commission”) pursuant to section 172E(2)(c) of the Electricity Act 1992 (“Act”).
2. The Act provides that, no later than 10 working days after making a recommendation to the Minister of Energy concerning the Rules, the Commission must publicise the recommendation.
Recommended Amendments to the Rules
3. On 5 September 2008, the Commission recommended that a number of amendments be made to the Rules concerning the reconciliation process contained in
Parts A, D, E, G, H and J of the Rules (“Reconciliation Rules”).
4. The effects of the recommended amendments to the Rules were to:
(a) alter the scope of some of the Reconciliation Rules to align the Reconciliation Rules with current practice or intended best practice to ensure the integrity of the overall reconciliation process;
(b) clarify the scope of some of the existing Reconciliation Rules;
(c) promote ease of understanding and interpretation; and
(d) resolve some minor drafting and wording issues,
to rectify cross-referencing, formatting, or other minor matters and effect other amendments in
order to achieve consistency within the Rules, and between the Rules and the Electricity Governance Regulations 2003.
5. Section 172F(3) of the Act provides that the Commission is not required to comply with section 172F(1) (relating to making an assessment) if it is satisfied that the recommendation will have only minor effects and will not adversely affect the interests of any person in a substantial way. In reliance on section 172F(3), no such assessment has been carried out.
