On 5 December 2008, the companies, under section 239I of the Companies Act 1993 (as amended), appointed Damien Grant and Steven Khov, of Waterstone Insolvency, as joint and several administrators.
Notice of First Meeting of Creditors
Notice is hereby given that a meeting of creditors will
be held at the offices of Hesketh Henry, 11th Floor,
41 Shortland Street, Auckland, on 16 December 2008 at 10.00am.
Registration for creditors will open at 9.30am.
The purpose of the meeting is to determine:
(a) whether to appoint a committee of creditors; and, if so
(b) who are to be the committee's members.
At the meeting, creditors may also by resolution:
(a) remove the administrators from office; and
(b) appoint someone else as administrator of the companies.
Notice to Secured Creditors
Notice is hereby given that any person who holds a valid charge over the whole, or substantially the whole, of the companies' property, has 10 workings days from the date of the administration to enforce its security, failing which it will lose its opportunity to do so, without specific leave of administrators or of the Court.
Notice of Watershed Meeting
Notice is hereby given that the watershed meeting of creditors of the above-named companies will be held at the offices of Hesketh Henry, 11th Floor, 41 Shortland Street, Auckland, on 18 December 2008 at 10.00am.
Registration for creditors will open at 9.30am.
The purpose of the meeting is:
1. to review the administrators' report.
2. for the creditors of the company to resolve whether:
(a) each company execute a deed of company arrangement;
(b) the administration should end; or
(c) the companies be put into liquidation.
3. any other issue properly bought before the meeting.
