Radiocommunications (Radio) Regulations (General Licence for Citizen Radio Apparatus) Notice 1999 Pursuant to regulation 13 of the Radiocommunications (Radio) Regulations 1993, and acting under delegated authority from the Secretary of Commerce, I give the following notice: N o t i c e 1. Short title and commencement (1) This notice may be cited as the Radiocommunications (Radio) Regulations (General Licence for Citizen Radio Apparatus) Notice 1999. (2) This notice comes into force on 4 February 1999. 2. General licence A licence under regulation 13 of the Radiocommunications (Radio) Regulations 1993 is granted in respect of the installation, operation and use, by persons in New Zealand of Citizen Radio apparatus intended for the transmission and reception of radiocommunications within New Zealand on frequencies between 26.30 MHz and 26.80 MHz. 3. Terms, conditions and restrictions (1) The frequencies available for use under this licence are those specified in the First Schedule to this notice. (2) The technical conditions applying under this licence are those specified in the Second Schedule to this notice. (3) This licence applies only to radio apparatus which complies with technical specification RFS23 (Issue 3, December 1988) and in respect of which a certificate of compliance has been issued by the Secretary under regulation 37 of the Radio Regulations 1987 or a declaration of conformity has been submitted to the Secretary under regulation 43 of the Radiocommunications (Radio) Regulations 1993. (4) Operators of radio apparatus pursuant to this licence must, during transmissions, clearly identify themselves. (5) The Secretary may, on request of an operator, provide a suitable callsign. (6) Radio apparatus used in the Citizen Radio Service may only be used to communicate with other radio apparatus in that service using voice (speech) only. (7) Frequency use is on a shared basis and the Secretary does not accept any liability under any circumstances for any loss or damage of any kind occasioned by the unavailability of frequencies or interference to reception. (8) Should interference occur the Secretary reserves the right to require that any radio apparatus licensed herein change frequency or cease operation. 4. Period of validity of licence This licence expires on 31 January 2004. This note prescribes that, pursuant to regulation 13 of the Radiocommunications (Radio) Regulations 1993, a general licence is granted in respect of the installation, operation and use of radio apparatus on frequencies specified in this notice. The previous general licence in respect of the frequencies specified is revoked. The licence applies only to radio apparatus which complies with technical specification RFS23 (Issue 3, December 1988) and in respect of which a certificate of compliance has been issued by the Secretary under regulation 37 of the Radio Regulations 1987 or a declaration of conformity has been submitted to the Secretary under regulation 43 of the Radiocommunications (Radio) Regulations 1993.
